Summary:
I am part of the Civil Actions Department. I deal with cases involving claims against public authorities that have the power to arrest, detain and prosecute such as the Police and the NHS.
I mainly deal with complex cases involving wrongful arrest, false imprisonment, malicious prosecution and misfeasance. These are usually clients who have been arrested, imprisoned and had to go through a lengthy trial and then acquitted of the charges in the end. For a lot of the clients this has resulted in them suffering not only financial but also psychological harm/loss.
Therefore the main aspect of my job is to gather vital evidence and examine this to determine the strengths and weaknesses of the case. Where clients have suffered psychological harm, the extent and duration of such harm/injury also needs to be determined.
These cases are often complex and require simultaneous examination of the legal and factual issue. The aim primarily is to place the client, as far as possible, in the position that they were in prior to the incident.
Expertise:
I have dealt with a lot of complex malicious prosecution cases involving client’s who have been charged and had to go through a trial and then found not guilty in the end. For a lot of these client’s the issue to consider is whether the police acted in good faith whilst investigating the matter and ensuring it went to trial.
This is a difficult area as it requires one to prove that the police acted with malice and continued with the matter without just and probable cause.
