Mental Health

Mental health law can potentially have a devastating affect on your personal life and we understand that you may have significant concerns arising from this. If your life is affected in any way by mental health law, you should contact us for free legal advice.

We can help you whether you are a detained patient, informal / voluntary patient, if you have come into hospital on a hospital order from either a court or prison or whether you are in the community on a treatment order. Additionally, we can also help a relative or a concerned friend of anyone who is affected in any way by mental health law.

We provide free legal representation to help you to speak to doctors, social workers and nursing staff amongst others involved in your care. The help we offer includes, amongst other things the following:

  • Appealing against your section, the renewal of your section or your admission to hospital to the Tribunal and Hospital Managers;
  • Seeking a variation or discharge of any conditions attached to your Community Treatment Order or Conditional Discharge;
  • Representing your nearest relative if they should seek a discharge on your behalf;
  • Raising your concerns to the relevant authorities regarding for example a change in your medication and whether you are receiving the correct type of treatment;
  • Free legal representation in your Care Programme Approach meeting (CPAs) / s.117 meetings;
  • If you want to be transferred to a less secure environment;
  • Obtaining or increasing your leave from the ward;
  • If unhappy with who your nearest relative is then we can look into applying for a change to who your nearest relative is;
  • We can examine your medical records for you;
  • We are also able to instruct an independent doctor/ independent social worker amongst others for a fresh assessment of your mental health;
  • Raising your complaint if you are unhappy about your care plan, the state of the ward that you are in, frustration at the lack of activities available to occupy your time on the ward, disturbance by other patients, physical restraints used on you for instance for the administration of your medication, you have been denied visitors, overcrowding, lack of privacy or if you do not have access to fresh air, recreational rooms or being able to make telephone calls;
  • We can also help you with issues surrounding your personal belongings, family life, finances or your aftercare in the community;

Our mental health department has been in operation since 2002. In that time we have successfully helped many people who have been affected by mental health law. Please contact us if you wish to be made aware of your human rights as a person affected by mental health law. If you are under any section of the Mental Health Act, for example, Section 2, Section 3, Section 37 we are experts in advising you of your rights. If you are an elderly patient suffering with Alzheimer or Dementia or if your doctor says you have the following examples of diagnosis; Drug Induced Psychosis, Depression, Bipolar Affective Disorder, Aspergers Syndrome, Schizophrenia, Personality disorder, Mood disorder or Stress related disorders or if you have been diagnosed at being at risk of Suicide, Self harm or Self neglect, please contact us in order to find out in which way we can assist you in overcoming any of these crisis.
